Eligibility Criteria

Individuals eligible for a Tax Residency Certificate include those who ordinarily live in Hong Kong, reside for over 180 days during a tax year, or stay for more than 300 days in two consecutive years, with one being the relevant year. Companies incorporated or constituted in Hong Kong, or those outside but managed or controlled in Hong Kong, also qualify.

 

Application Process

Download the relevant application forms from the IRD’s website based on the applicable DTA and applicant type (individual or company).

Submission of the application form involves providing detailed information:

  • Applicant details
  • Employment particulars or business operation details in Hong Kong
  • Nature and amount of income from the treaty party
  • For Companies / Partnerships / Trusts / Bodies of Persons:
  • Applicant particulars, nature of business
  • Location of headquarters and main branches
  • Details of directors, partners, trustees, or principal officers
  • Nature and amount of income from the treaty party
  • Location of management and control exercise
  • Processing Time:

The processing of the Certificate takes approximately 21 days. Insufficient information may prompt a request for additional supporting documents.
Issuance:

Upon completion, the Certificate of Resident Status is delivered by post. For those opting to collect it in person, a written request must accompany the application form and required documents.
