Cross-Boundary Data Flow Now Open to All Sectors in the Greater Bay Area
The Digital Policy Office (DPO) has extended the facilitation measures under the Standard Contract for the Cross-boundary Flow of Personal Information to encompass all industry sectors within the Guangdong-Hong Kong-Macao Greater Bay Area (GBA). This new rule, which was made effective immediately, follows the 2024 Policy Address. It will help businesses and the public by allowing smoother and safer data sharing across the GBA.
A Big Step for Data Sharing
The GBA Standard Contract was first introduced in 2023. It started with only a few sectors, like banking, credit referencing, and healthcare. This was part of an agreement between the Innovation, Technology and Industry Bureau (ITIB) and China’s Cyberspace Administration. Now, all industries can use it to simplify data sharing between Hong Kong and the nine Mainland cities in the GBA.
How the GBA Standard Contract Works
The contract provides a ready-made template for companies to follow. It sets clear rules to protect personal information when shared across borders. In addition, businesses must follow privacy laws in their area. For example, in Mainland China, the Personal Information Protection Law applies, while Hong Kong businesses must follow the Personal Data (Privacy) Ordinance (PDPO).
